Terms & Conditions

1. Introduction

These Terms and Conditions govern the provision of Lead Generation Consulting services by Social Swan Media (referred to hereafter as "Social Swan," "we," "us," or "our") to the Client (referred to hereafter as "Client," "you," or "your"). Our services are exclusively focused on generating qualified, high-value tour and booking enquiries for the Client's event or wedding venue.

2. Scope of Service

2.1 Service Definition: Social Swan provides specialised Meta (Facebook/Instagram) advertising campaign management and sales funnel optimisation services, known as the Booking Catalyst System, aimed at reducing the Cost Per Qualified Lead (CPQL) and increasing the volume of confirmed tour bookings.

2.2 Exclusions: Our service expressly excludes general social media management, content creation, graphics design, or engagement posting. We are a lead generation consultancy only.

3. The 14-Day Performance Challenge

3.1 Purpose: The Challenge is a pilot programme designed to prove the efficacy of the Booking Catalyst System using real-world data and the Client's dedicated ad budget.

3.2 Challenge Fee: The management fee for the 14-Day Performance Challenge is £0 (zero pounds).

3.3 Ad Budget: The Client shall be solely and directly responsible for allocating and paying a minimum Ad Budget (e.g., £300 to £500) to Meta during the Challenge period. Social Swan is not responsible for, nor liable for, any expenditure relating to the Client’s Ad Budget.

3.4 Termination: Either party may terminate the Challenge at any point without notice or penalty.

4. Access and Client Responsibilities

4.1 Account Access: The Client agrees to provide Social Swan with necessary access to the Meta Ad Account and associated business assets via Meta Business Manager Partner Request. Social Swan will never request, nor store, the Client's social media passwords.

4.2 Sales Process: The Client acknowledges and agrees that Social Swan is responsible for the delivery of qualified leads to the Client’s inbox or CRM. The Client remains solely responsible for the subsequent lead follow-up, tour conversion, and final booking closure.

4.3 Exclusivity of Lead Data: All lead data, including names, emails, phone numbers, and event requirements, generated during the service period is the exclusive property of the Client. Social Swan guarantees this data will never be shared, sold, or re-marketed to any other venue or third party.

5. Financial Terms and Ongoing Service Fee

5.1 Ongoing Service Agreement: Following the successful completion of the 14-Day Performance Challenge, Social Swan will present a full-scale partnership proposal. The subsequent ongoing service fee (Retainer) will be subject to a separate written agreement.

5.2 Billing Cycle: The Client will be invoiced monthly in advance for the ongoing service fee.

5.3 Payment Terms: Invoices are due for payment strictly within 14 days of the invoice date.

5.4 Late Payment: Social Swan reserves the right to suspend all services, including ad campaign management, if payment is not received within 7 days of the due date. Statutory interest may be charged on overdue payments as per UK legislation.

5.5 Ad Budget: This fee does not include the Client's dedicated ad budget, which must be managed and paid directly to Meta Platforms, Inc.

5.6 Cancellation: Following the Ongoing Service Agreement, either party may terminate the service by providing 30 days written notice.
